Overname Full Tilt Poker op losse schroeven

Onheilspellende berichten vanuit de Groupe Bernard Tapie bereikten gisteren de openbaarheid. Terwijl er de laatste weken juist stappen vooruit gezet leken te worden, liet Behnam Dayanim, advocaat van de Groupe Bernard Tapie, gisteren weten dat een deal op het moment ver weg is. Rede hiervoor is dat voormalig Team Full Tilt spelers, waaronder Phil Ivey, David Benymine, Erick Lindgren, Mike Matusow en Barry Greenstein hun voormalig werkgever nog tussen de 10 en de 20 miljoen dollar verschuldigd zijn.

“The diligence has revealed that the financial position is worse than we had anticipated,” zo vertelde Dayanim tegenover Gaming Intelligence. “We do not want to litigate a whole bunch of individual cases against professionals post-acquisition so we are trying to negotiate but we have not been making a lot of progress. This is not the only issue that is holding up the sale but it is a significant one. The company has greater liabilities — excluding player liabilities — than we had hoped. The forfeiture would extinguish any U.S. claims to the assets but they do not necessarily extinguish creditor claims in other countries.”

De schulden van de voormalig Team Pro's zijn pas recent aan het licht gekomen en zijn op het moment een van de belangrijkste hindernissen die overwonnen moeten worden alvorens er een deal bereikt kan worden. Dayanim vertelde tegenover PokerNews.com:

"The reality is this. If we are unable to resolve some of these substantial obstacles that stand in the way of the completion of the deal, we won’t be able to complete the deal. If we don’t complete the deal, then the rest of the world players won’t be compensated nor made whole because we won’t be there to do it, and the government would have less money than it otherwise would to pay the U.S. players to the extent that it plans to do so. That’s the reality. We really need to resolve some of these issues in order to be able to purchase the company. This is a significant issue."

I have been inundated with calls from all the poker media sites regarding this, so it's easier for me to respond in one place. Obviously, 2+2 has become the main place where people discuss online poker so I'm posting here. It would be nice if everyone who owes money discusses it openly so there is a better chance that they will make good on their debts and the money will end up in the pockets of players with balances on FTP.

My statement to the press and the poker community:

I borrowed $400,000 to play on Full Tilt a few years ago, before PokerStars had high stakes games. I didn’t pay it back, hoping that some people who owed me and had money on Full Tilt would pay me there so I could use that against the debt. (I'm only owed about $150,000 now). I have assumed when this case is resolved, the DOJ will allow methods for dealing with debt to FTP.

Tapie Group contacted me last week and asked if I would pay them directly. Their attorney offered me the opportunity to pay in installments so I could have a chance to use money owed to me. He even offered me the opportunity to discount my debt if the US players don’t get paid in full. I told him that I have never paid less than I owe on any debt and I would rather wait until the DOJ establishes a fund for the US players. I don't believe my debt has any impact on the sale to the Tapie group as they have alleged. I was concerned about taking money due to US players and giving it to the Tapie Group because it is understood that the Tapie Group won't be the one paying the US players. On the other hand, I realize that the total debt counting other players is substantial, especially because I would include in that tally any money taken from FTP once it had become insolvent.

Here is an excerpt from the letter I sent to their attorney:

“The consensus in the poker community is that all money owed to Full Tilt or taken by investors after the company became insolvent should be used to pay back player’s funds. If I were to make a deal with you it would look like I had turned my back on the best interests of the American players.

Even though the terms are easier for me if I deal with you and it will fulfill my legal obligation, I have to see how things work out with the DOJ and try to make good on my moral obligation to the US players. I assume at some time in the future the DOJ will establish a pool of funds from Full Tilt’s assets that will be used to pay off some percentage of the player balances that are owed.”

Jonathan Duhamel heeft de helft van zijn geld terug

Goed nieuws voor Jonathan Duhamel. De helft van de $160.000 die uit zijn huis gestolen werden tijdens de gewelddadige roofoverval enkele maanden geleden, is teruggevonden. De politie vond na een aantal anonieme tips de $80.000 terug in een postbus in Montreal. Eerder mocht Duhamel de gestolen Rolex al terug op de arm doen. Waar de rest van het geld én zijn gouden bracelet is, is nog onduidelijk.

Zijn ex-vriendin Bianca Rojas-Latraverse, John-Stephen Clark-Lemay en Anthony Bourque werden kort na de overval gearresteerd. Binnenkort horen zij hun definitieve straf van de rechter.

Fertitta Interactive vraagt Nevada licentie aan

Fertitta Interactive, moederbedrijf van de UFC en Stations Casinos, heeft een licentie aangevraagd welke hen het recht geeft om online poker aan te bieden in de staat Nevada. De aanvraag volgt kort nadat het bedrijf online gaming provider CyberArts LLC overnam. Eerder ging het bedrijf een samenwerkingsverband met Full Tilt Poker aan, maar deze kwam te vervallen na Black Friday.

"We support the regulation of online poker," aldus Lorenzo Fertitta. "Our industry leading software has a track record of complying with the strictest regulations in jurisdictions around the world."

"Nevada has always been the leader in gaming regulation and we're pleased to file our application here," vervolgt hij. "Our goal is to provide customers with the best online gaming experience in a safe and well-regulated online environment."
